Welcome to Awaeken. These Terms of Service outline the conditions that apply when you visit our website, place an order, or interact with our team. By browsing our website or completing a purchase, you agree to these terms and our Privacy Policy. If you do not agree, we kindly ask that you refrain from using our website.

Article 1 – Scope

These terms apply to all visits, orders, and transactions conducted through www.awaeken.world. Awaeken is a trade name of Maryci. All agreements are entered into with Maryci.

Article 2 – Age & Account Details

By using our website, you confirm that you are 18 years of age or older, or that you have obtained consent from a parent or guardian. Should you create an account, you are responsible for the accuracy of your information and for keeping your login credentials secure.

Article 3 – Product Information

We present each piece in our collection with as much care and accuracy as possible. Minor variations in colour, texture, or appearance may occur due to differences in screen settings, this does not affect your statutory rights. Product information may be updated or refined over time.

Article 4 – Orders

An order is only confirmed once you have received a confirmation from us by email. We reserve the right to decline an order in circumstances such as:

  • A product is no longer available
  • An evident pricing error has occurred
  • There are reasonable grounds to suspect misuse or fraud

Should we be unable to fulfil your order, you will be notified promptly.

Article 5 – Pricing & Payment

All prices are displayed in euros, inclusive of VAT and exclusive of shipping costs unless stated otherwise. Price adjustments may occur, but will never apply retroactively to orders already placed. You are required to provide accurate and current payment information at the time of purchase.

Article 6 – Shipping & Delivery

We are committed to careful and timely fulfilment. Delivery times are estimates and may vary. Legal risk remains with us until the moment your order is physically in your hands. In the event of a failed delivery due to incorrect address details provided by you, any additional shipping costs will be your responsibility.

Article 7 – Returns & Right of Withdrawal

All orders shipped within the European Union are subject to the statutory 14-day right of withdrawal. As a gesture of confidence in our collection, we voluntarily extend this to a 30-day return window.

Return conditions:

  • The item has only been tried on as it would be in a physical store.
  • The item is undamaged, unwashed, and has all labels intact.
  • Should an item show signs of use beyond what is necessary to assess it, a reduction in value may be applied to the refund.

Return shipping:

  • For standard returns, shipping costs are the responsibility of the customer.
  • For defective or incorrectly delivered items, we will cover the return shipping in full.

Refunds upon withdrawal:

  • We will process your refund within 14 days of withdrawal.
  • We reserve the right to await the return of the item or confirmation that it has been sent, before issuing the refund.

Article 8 – Warranty & Conformity

Every piece we offer is guaranteed to be in accordance with its purchase agreement and to meet reasonable expectations of quality and performance, in line with EU consumer law. Should a product prove defective within the applicable statutory period, you are entitled to repair, replacement, or reimbursement at no cost to you.

Article 9 – Intellectual Property

All designs, text, imagery, and materials on our website are the property of Awaeken or our partners. Reproduction, modification, or distribution of any kind is not permitted without prior written consent.

Article 10 – Reviews & Feedback

By submitting a review, you grant us permission to use your feedback for marketing and quality purposes. We reserve the right to remove reviews that are misleading, offensive, or otherwise unlawful.

Article 11 – Website Use

Our website is intended for personal, non-commercial use. You may not use it to engage in fraudulent activity, distribute harmful software, pursue commercial interests without our consent, or in any way disrupt the functionality of the platform.

Article 12 – Limitation of Liability

We do not exclude liability where prohibited by law. To the extent permitted, our liability is limited to the amount you paid for the item in question. We are not liable for any damage arising from failure to follow care or washing instructions.

Article 13 – Force Majeure

In the event of circumstances beyond our reasonable control including but not limited to strikes, transport disruptions, pandemics, or natural disasters. We reserve the right to delay or cancel deliveries without incurring liability.

Article 14 – Privacy

Your personal data is processed in accordance with our Privacy Policy. By placing an order, you agree to this processing.

Article 15 – Amendments

We reserve the right to update these terms at any time. The most current version will always be available on our website. In the event of significant changes, we will notify you by email or through the website.

Article 16 – Governing Law

These terms and all transactions are governed by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.
